Last June, we reported on a consent decree entered into by the U.S. Attorney’s Office in Philadelphia and the law firm Rosenbaum & Associates, following the firm’s failure to pay $14,000 in past CMS liens related to multiple clients. Under the decree, the firm was required to pay double the lien amount—$28,000, in addition to implementing stringent internal process reviews, training protocols, and third-party auditing. The agreement also stipulated that any further violations would be treated as False Claims Act infractions.
Fast forward to March 18th, and now the U.S. Attorney for the District of Maryland has hit Meyers, Rodbell & Rosenbaum, P.A. with a $250,000 settlement and similar corrective terms—this time, stemming from a single unpaid lien related to a medical malpractice claim.
ANYONE SEE A TREND?
CMS compliance is becoming increasingly complex, and plaintiff lawyers are now directly in the crosshairs of CMS enforcement. This trend underscores not only the risk of liability related to past conditional payments but also the growing malpractice exposure surrounding CMS’s future interests.
And if that weren't enough, Medicare Advantage Organizations (MAOs) continue to expand their enforcement footprint—asserting Secondary Payer Act rights for both past reimbursements and projected future care.
